This End User License Agreement and Terms of Use (the "Agreement") is a binding legal contract between you ("you," "your," or "User") and Boole ("Boole," "we," "us," or "our"), the developer of the Fruit People mobile application and related services (together, the "App").
By downloading, installing, accessing, or using the App, you confirm that you are at least 18 years old and that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not download, install, or use the App.
1.Relationship with Apple
You acknowledge and agree that this Agreement is concluded solely between you and Boole, and not with Apple Inc. ("Apple"). Boole, and not Apple, is solely responsible for the App and its content. Your use of the App must also comply with the App Store Terms of Service and the Apple Media Services Terms and Conditions, including the Usage Rules set out in those terms.
The specific terms required by Apple for applications licensed through the App Store are set out in full in Section 17 (Apple App Store Additional Terms). To the extent of any conflict between Section 17 and any other provision of this Agreement, Section 17 controls with respect to your use of the App on Apple-branded devices.
2.Eligibility (18+)
The App is an adult product intended only for users who are 18 years of age or older (or the age of legal majority in your jurisdiction, if higher). The App is not directed to children, and we do not knowingly permit anyone under 18 to create an account or use the App.
During onboarding you are required to confirm that you are at least 18 years old. By using the App you represent and warrant that:
you are at least 18 years old;
you have the legal capacity to enter into this Agreement; and
your use of the App is not prohibited by any applicable law.
If we learn that a user is under 18, we will terminate the account and delete associated data. If you believe a minor is using the App, contact support@fruitpeople.fun.
3.The App & AI Companions
Fruit People is an AI companion app. It lets you exchange text messages with, and place real-time voice calls to, fictional artificial-intelligence characters ("fruit people") who reside in a fictional setting known as "Cashew Street." These characters are software. They are not real people, and no human is on the other end of your conversations or calls.
Text messaging is generally available at no additional charge. Voice calls consume a metered minute allowance; new users receive a limited amount of complimentary voice minutes, and continued voice access requires an active subscription, as described in Section 9.
4.AI Disclaimer
The characters in Fruit People are fictional AI, not real individuals. All character responses are automatically generated by artificial-intelligence models and do not reflect the views, statements, or knowledge of any real person, including any person a character may resemble.
You understand and agree that:
Responses are generated and may be wrong. AI-generated content can be inaccurate, incomplete, outdated, offensive, or otherwise unreliable. You should independently verify any information before relying on it.
Not professional advice. The App does not provide medical, mental-health, legal, financial, or other professional advice, and no content from the App should be treated as such. If you are experiencing a crisis or medical emergency, contact your local emergency services or a qualified professional.
No real relationship. Interactions with characters are entertainment and simulate conversation. They do not create any personal, romantic, fiduciary, therapeutic, or professional relationship, and characters cannot form genuine feelings, obligations, or commitments.
Fictional content. Characters, personas, backstories, and dialogue are works of fiction. Any resemblance to real persons or events is coincidental or used in a fictional manner.
5.Accounts & Sign In
To use the App you create an account using Sign in with Apple. In connection with your account we collect and process a limited set of information, including a display name you choose, a gender you self-select, your confirmation that you are 18 or older, and an Apple-provided user identifier and relay email address. We may in the future support phone-number-based sign-in.
You are responsible for maintaining the confidentiality of your device and account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. You may delete your account at any time from within the App; deleting your account removes your account and associated data as described in Section 11.
6.License Grant & Scope
Subject to your compliance with this Agreement, Boole grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on any Apple-branded device that you own or control, solely for your personal, non-commercial use, and strictly in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions.
This license does not allow you to use the App on any device you do not own or control, and except as permitted by the Usage Rules you may not distribute or make the App available over a network where it could be used by multiple devices at the same time. All rights not expressly granted to you are reserved by Boole and its licensors.
7.Acceptable Use
You agree that you will not, and will not attempt to, do any of the following:
use the App for any unlawful purpose or in violation of any applicable law or regulation;
harass, threaten, defame, stalk, or abuse any person, or use the App to facilitate any such conduct;
generate, solicit, request, or attempt to elicit any content that sexualizes, exploits, or endangers minors, or that depicts child sexual abuse material, or that portrays any character as a minor in a sexual context;
generate, solicit, or attempt to elicit content that is otherwise prohibited, including content that promotes terrorism or violent extremism, incites violence, facilitates human trafficking, or depicts non-consensual sexual conduct;
attempt to circumvent, disable, or defeat any safety, content-moderation, age-gating, or usage-limit feature of the App;
scrape, crawl, harvest, or index the App or its content, or extract data by automated means;
reverse engineer, decompile, disassemble, or attempt to derive the source code, models, or underlying prompts of the App, except to the limited extent such restriction is prohibited by applicable law;
copy, modify, distribute, sell, rent, lease, or create derivative works from the App or its content;
interfere with, disrupt, or place an unreasonable load on the App or its infrastructure, or introduce malware or other harmful code;
use the App to develop or train a competing product or model.
Violation of this Section may result in immediate suspension or termination of your account and, where appropriate, referral to law enforcement.
8.User Content, Reporting & Blocking
"User Content" means the text messages, voice input, display name, and other content you submit to the App. You retain any rights you hold in your User Content. You grant Boole a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and use your User Content solely to operate, provide, secure, moderate, and improve the App, including transmitting it to the third-party AI provider described in Section 10 in order to generate responses.
You are solely responsible for your User Content and represent that you have the rights necessary to submit it and that it does not violate this Agreement or any law.
Objectionable content and moderation. We do not tolerate abusive, harassing, or otherwise objectionable content or behavior. The App provides tools that let you:
Report content. You may report objectionable content or behavior from within the App. Reports are reviewed within 24 hours, and we may remove content, restrict features, or remove users who violate this Agreement.
Block a character. You may block a character at any time to stop further interactions with it.
We reserve the right, but assume no obligation except as required by applicable law or platform rules, to monitor, review, and remove User Content and to take action against accounts that violate this Agreement.

What the subscription provides
A voice-minute balance that starts at 20 minutes, replenishes by 5 minutes each day, and is capped at 20 minutes at any time
Free minutes and texting. Texting with characters is available at no additional charge. New users receive 5 free voice-call minutes. Once your free minutes are used, continued voice calling requires an active subscription. Subscribed voice access draws from a voice-minute balance that starts at 20 minutes, replenishes by 5 minutes each day, and is capped at 20 minutes at any time. Unused minutes roll over up to that cap; the balance does not reset daily. These amounts may change over time, and any change will be reflected in the app. See our Privacy Policy and this agreement for details.
Auto-renewal
The Fruit People subscription is an auto-renewable subscription. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews for successive one-month periods at USD 14.99 per month unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.
Managing and cancelling
You can manage your subscription and turn off auto-renewal at any time in your Apple ID account settings (Settings → your name → Subscriptions, or through the App Store). Subscriptions are managed and cancelled through your Apple account, not by Boole. Cancellation takes effect at the end of the current billing period, and you retain subscription access until then. Deleting the App does not cancel your subscription.
Refunds
All purchases are processed by Apple. Boole does not directly process payments and does not issue refunds. Any refund requests are handled by Apple in accordance with the Apple Media Services Terms and Conditions and Apple's applicable refund policies. Except where required by law, subscription fees are non-refundable, and partial billing periods are not refunded.
Price changes
We may change subscription pricing or the features included in a subscription. Where required, price changes affecting an existing subscription will be communicated to you and, where required by Apple or applicable law, will require your consent before taking effect.
Payment is handled entirely by Apple. Boole never sees or stores your payment card details.
10.Third-Party Services
The App relies on third-party service providers to function. You acknowledge that:
xAI. Your text messages and voice audio are transmitted to xAI (the Grok real-time API) to generate AI character responses. Voice audio during calls is streamed in real time to this provider and transcribed for the purpose of generating replies. Your use of these features is subject to xAI's applicable terms.
DigitalOcean. The App's backend is hosted on DigitalOcean infrastructure.
Apple. In-App Purchases and Sign in with Apple are provided by Apple and are subject to Apple's terms.
You agree to comply with any applicable third-party terms of agreement when using the App. Boole does not control and is not responsible for the practices of these third parties, and their terms and privacy policies govern your relationship with them. We do not sell your personal data, and the App does not use third-party advertising trackers.
11.Privacy & Data
To operate the App we collect and process a limited set of data, including: the display name you provide; the gender you self-select; your 18+ age confirmation; your text chat messages; voice audio during calls (streamed in real time to the AI provider and transcribed to generate replies); basic usage and diagnostic information; and, for authentication, your Apple-provided user identifier and relay email (and, in the future, a phone number). Payment information is handled by Apple; we never see your card data.
We use this data to provide, secure, moderate, and improve the App. We do not sell your personal data, and we do not use third-party advertising trackers. Data may be processed by the third-party providers listed in Section 10.
Your controls. You may delete your account at any time from within the App, which removes your account and associated data. You may also report content and block characters as described in Section 8. For privacy questions or requests, contact support@fruitpeople.fun. Where a separate Privacy Policy is provided, it is incorporated into this Agreement by reference.
12.Intellectual Property
The App, including its characters, names, artwork, text, audio, software, models, prompts, look and feel, trademarks, and all related intellectual property, is owned by Boole or its licensors and is protected by intellectual-property and other laws. Except for the limited license granted in Section 6, this Agreement does not transfer any ownership or rights in the App to you.
"Fruit People," "Cashew Street," and related names and marks are marks of Boole. You may not use them without our prior written permission.
13.Term & Termination
This Agreement is effective until terminated. You may terminate it at any time by deleting your account and removing the App from your devices. We may suspend or terminate your access to the App, with or without notice, if you violate this Agreement, if required by law or platform rules, or to protect the App, other users, or third parties.
Upon termination, the license granted to you ends and you must stop using the App. Termination does not entitle you to any refund except as required by law or Apple's policies. Sections that by their nature should survive termination (including Sections 4, 7, 12, 14, 15, 16, 17, and 18) survive.
14.Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, Boole and its licensors and suppliers disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement.
Boole does not warrant that the App will be uninterrupted, secure, error-free, or free of harmful components, that defects will be corrected, or that AI-generated content will be accurate, appropriate, or reliable. Any content or material obtained through the App is accessed at your own discretion and risk.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
15.Limitation of Liability
To the maximum extent permitted by applicable law, in no event will Boole or its officers, directors, employees, agents, licensors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the App or any AI-generated content, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not Boole has been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, the total aggregate liability of Boole arising out of or relating to this Agreement or the App will not exceed the greater of (a) the amounts you paid to Apple for the App or subscription during the twelve (12) months preceding the event giving rise to the claim, or (b) USD 50.
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you.
16.Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Boole and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your use or misuse of the App; (b) your User Content; (c) your violation of this Agreement; or (d) your violation of any law or the rights of any third party.
17.Apple App Store Additional Terms
The following additional terms apply to your use of the App obtained through the Apple App Store. You and Boole acknowledge and agree as follows:
Acknowledgement
This Agreement is concluded solely between you and Boole, and not with Apple. Apple is not a party to this Agreement. Boole, not Apple, is solely responsible for the App and its content. To the extent this Agreement is inconsistent with the Apple Media Services Terms and Conditions or the App Store Terms of Service, those Apple terms govern with respect to your use of the App.
Scope of License
The license granted to you for the App is a limited, non-transferable license to use the App on any Apple-branded products that you own or control, and only as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where enabled.
Maintenance and Support
Boole is solely responsible for providing any maintenance and support services with respect to the App, as required under applicable law. You and Boole acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Warranty
Boole is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Boole.
Product Claims
Boole, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of any third-party frameworks.
Intellectual Property Rights
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Boole, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the App. You acknowledge and agree that Boole is not responsible for examining or evaluating the content or accuracy of any third-party service used in connection with the App.
Third-Party Beneficiary
You and Boole acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of it.
18.Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts located in the State of Delaware, United States of America to resolve any dispute arising out of or relating to this Agreement or the App, except that this choice of law and forum does not override any mandatory consumer-protection rights available to you under the law of your country of residence, and does not limit Apple's rights as a third-party beneficiary under Section 17.
19.Changes to this Agreement
We may update this Agreement from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the App after an updated Agreement takes effect constitutes your acceptance of the changes. If you do not agree to the updated Agreement, you must stop using the App.
